DEFORMALIZATION OF CRIMINAL PROCEEDINGS THROUGH THE USE OF MODERN TECHNOLOGIES IN THE CONTEXT OF FORENSIC EXAMINATION

Abstract:
In the study the author considers the prospects for the use of digital technologies in the field of criminal justice in the context of the appointment and production of a forensic examination. The main goal of the study is to analyze the current legislation, investigative and judicial practice, as well as scientific works to define the concept of ʺdeformalizationʺ. The author substantiates its main features and principles in the context of forensic activities. What is more, the author also highlights the goal of substantiating the need to use this concept in criminal procedure and introducing it into scientific circulation. To achieve these goals, the article sets the task, using general scientific and comparative legal methods of cognition, to assess the prospects for borrowing foreign experience and its implementation in Russian criminal procedure and forensic activities. The result of the study is the development of the concept of deformalization, as well as the allocation of its main principles for the purposes of appointment, forensic examination, as well as for coordination and interaction between expert institutions and law enforcement agencies. The author concludes that deformalization is understood as the process and result of optimization of criminal proceedings and related areas of activity through its digitalization for the purposes of the most objective, productive and prompt establishment of circumstances subject to proof in compliance with the requirements of relevance, admissibility, reliability and sufficiency of evidence, as well as to facilitate coordination and interaction between the subjects of criminal proceedings.
