The author evaluates in a critical manner the adversary Code of Criminal Procedure of the Russian Federation denying the objective truth and not going beyond the formal logical law of identity: “argument for the sake of argument” and “may the best man win”. The article concentrates on the necessity to use materialistic dialectics as the genuine scientific law of thinking and cognition. Dialectics requires criminal procedure based on the objective truth, as distinguished from criminal procedure based on the formal legal “adversary-winning” truth.
