FEATURES OF PROBATIVE MATTER OBTAINING BY FEAT OF WITNESSES INTERROGATION WHILE INVESTIGATING ILLEGAL BANK ACTIVITY

Abstract (English):
The question of the obtaining probative matter while detecting illegal bank activity is studied in the article. The categories of the witnesses keeping informed about the phony companies’ registration and encashing are shown. Witnesses’ interrogation plays an important role in the criminal investigation. Moreover, the testimony is the evidentiary basis in proving criminal guilt of the subject. Investigating financial crimes including illegal bank activity involving phony companies and encashing, the investigator faces the necessity of obtaining probative matter from several tens of witnesses and in some criminal cases the amount of the interrogated witnesses grows to several hundreds. Preliminary investigation has different tactics of interrogation according to the specific of the subject, motive, modus operandi, ways of crimes category detection, nature of the initial information of the crime and the given detective circumstances. It is not only the familiarity with the initial criminal case data can help the investigator to define the witnesses who obtain the proper probative matter but also the permanent analyses and examining of the materials of existing detective activity and other operational procedures. As the practices show, interrogation of the witnesses obtaining inessential probative information according to the investigator, can reveal the data completely chan ging the main investigative lead of the crime.
