This article is dedicated to Professor V.T. Tomin’s scientific works on the occasion of his 80th anniversary. Current issues and ideas of his works are discussed. The idea about the necessity of the clear separation of two different types of the criminal proceeding: competitive (winning-losing) and objectively-true is leaded through the article. At the competitive proceeding competitiveness is inherently valued and excludes objective truth; goal and principles provide competitiveness, “contest for contest” and are subordinated to the determination of the strongest winner of the legal issue. At the competitive proceeding everything is competitive, including morality. Competitively-winning (formally-judicial) truth is settled after the criminal proceeding. At the objectively-true proceeding goal and principles are oriented on the trustworthy crime detection; determination of the objective truth, at this type of process morality is objectively true.
