The article deals with the analysis of legislation and law enforcement practice for recourse requirements to the police officers. The author examines the debatable position concerning establishing a clear mechanism to impose civil liability on officials. In particular, the author examines the characteristics of civil liability while doing harm by police officers, where the person to whom property damage has been done, is the Russian Federation. The article reveals problematic aspects of enforcement practices in the implementation of the norms of the Civil Code of the Russian Federation concerning compensation for damage caused while performing official duties by police officers. The author provides the statistics on court cases of the given category of disputes, and the conflicts of enforcement nature are examined. The author proves the necessity to clarify by the Plenum of the Supreme Court of the Russian Federation the issue of proving procedure of the defendant guilt in the disputes related to the recourse requirements imposed on the police officers.
