THE RIGHT TO APPEAL PROCEEDINGS AND DECISIONS IN OBJECTIVELY TRUE AND ADVERSARIAL CRIMINAL PROCESS AS THE PRINCIPLE

Abstract (English):
The article focuses on the institute of the criminal procedural complaint. The authors consider that the outcome of the complaint will be different in various types of the criminal process: adversarial (winner-loser) and objectively true. Thus, the appeal is one of the aspects for establishing the objective truth in objectively true type of the criminal process and it also assists a credible crime solution (fight against crime) as a common purpose of the criminal process. That is the procedural complaint has an objectively true nature and direction in objectively true criminal process. Unlike it adversarial type of the criminal process (Criminal Procedural Code of the RF) in view of its adversary character doesn’t admit an objective truth (the winner is determined by the prosecution and defense in the adversarial process); procedural complaints have an adversarial-winning direction regardless of whether the position of the prevailing party is true or not in such type of criminal process. In adversarial type of the criminal process the adversarial form (procedure) has primacy over the problem of establishing the case facts (the procedure is more important than the objective truth), therefore on the whole the procedural complaints deal with the violations of the procedural form by the opposite party in the legal issue (while being won). The authors support the objectively true type of the criminal process; they consider the objectively true justice in the criminal process to be above the equity of the winner in the adversarial criminal process.
