In the work on the basis of the author's analysis of modern law enforcement practice, complex issues relating to the application of criminal law provisions, stipulated in Art. 159.3 of the Criminal Code of the Russian Federation, primarily to the qualification of fraud committed using payment cards. The authors suggest possible options for their solution, taking into account the theoretical approaches to determining the content of certain objective and subjective features of the main and qualified fraudulent forms using payment cards in the criminal legal doctrine. Practical recommendations addressed to the law enforcer are given on the delimitation of this type of fraud from related crimes, including theft. The criteria for such delimitation and their content are specified. The work actively uses the latest investigative and judicial practice in cases of fraud with the use of payment cards, there are typical mistakes made when applying the investigated criminal law.
