CONDUCTING SEARCH IN THE INVESTIGATION OF ILLEGAL ENTREPRENEURSHIP CASES: CRIMINAL AND CRIMINALISTIC PROCEDURE

Abstract (English):
The article deals with the issues of the criminal procedural order of conducting search in the Republic of Belarus and raises the problems of regulating this investigative action under the Criminal Procedure Code of the Republic of Belarus. Criminalistic features of conducting search in criminal cases on illegal business activities are revealed depending on the way of committing criminal acts. Typical mistakes made in the course of conducting search. Practical solutions are offered. The author raises the question about the specialist’s mandatory participation in the search conducted in commercial organizations in order to obtain the most optimal and complete evidence excluding the withdrawal of information carriers irrelevant to the case. Later it can involve an unreasonable increase in the investigation time and the difficulty in assessing the information provided when the criminal case is examined by the court.
