The article is sanctified to the analysis of new rules of production of inquisitional actions in regard to an advocate. The basic idea of legislator, based on legal positions of Constitutional Court of Russian Federation, is seen in that by establishment of borders of discretion of public servants at the production of search, coulisse and (or) examination to barrier an advocate production from excessive interference with him law enforcement authorities and to create the additional guarantees of confidentiality of providing of skilled legal help an advocate to the principal. Analyzing the article 450.1 of Code of criminal procedure of Russian Federation, an author pays attention, that from text of norm not quite clear, whether new features operate only in those cases, when in regard to an advocate laid an action or a decision is taken away about bringing in of him as a defendant, but also in those cases, when the criminal proceeding in regard to an advocate does not come true. Connection of features of production of inquisitional actions is shown in regard to an advocate with the limits of production in criminal case, including for crimes. In addition it is impossible safely to say that new limitations will answer the declared aims and will not become an additional privilege for persons trying to go away from the responsibility set by a law.
