The article deals with the problem of legal substantiation of the right to delegated law-making by «white» regimes during the Civil War in Russia in 1918-1919. In the process of research, the author concentrates on the role of the All-Russian Constituent Assembly, dissolved by the bolsheviks in January 1918, which became a symbol of struggle for the social-democratic anti-bolshevik camp. However, for «white» regimes this type of representation had minor legitimacy because of its socialist character. In this connection, the main attention is paid to two centers of concentration of «white» statehood, which tried to solve the problem of delegated law-making: in the South, headed by the Commander-in-Chief of the Armed Forces in the South of Russia A. I. Denikin, and in the East, headed by the Supreme Ruler of Russia admiral A. V. Kolchak. Also, the work investigates the activities of the «white» regimes aimed at creating higher representative (legislative) authorities. Concluding the study, conclusions are drawn about the role of delegated law-making under wartime conditions and the consequences of delegating the legislative powers of the executive branch of government.
