For the past years the most states of the United States have adopted a new legislation aimed at expanding the possibility to use lethal force to ensure self-defense of property. These bills taken together received their informal name as Castle doctrine. The purpose of research was make a comprehensive analysis of the Doctrine of necessary defense according to the legislation of the USA in correlation to the principle of inviolability of housing according to the legislation of the Russian Federation. Conclusions based on the comparative analysis of the concept of housing fixed in the housing legislation and criminal and procedure one of the Russian Federation as well as in the legislative acts of certain US states are made about the necessity to expand the concept of housing developed by the Russian legal science. The key aspects to protect the property by legal means according to the US criminal law are considered. Issues of the general principles of the law of necessary defense as well as the specific types and limits of such law are analyzed. Ways used by law enforcement officers to enter any housing in a legal way and not to violate inviolability of property are characterized. While making the comparative analysis of the legislation of Russia and the legislation of the United States certain provisions are identified; they can be adopted by the Russian legislation contributing thereby to the most complete implementation of the principle of the inviolability of housing.
