SITUATIONAL APPROACH IN FORMING THE SUBJECT OF FORENSIC LINGUISTIC EXPERTISE

Abstract:
The study was conducted with the aim of developing criteria for the assessment of the expert report, which should be taken into account by the expert when examin-ing the order for appointment of a forensic linguistic expertise. This was done using a situational approach, which allowed to consider the process of evaluation of the questions posed as a set of individual expert situations and ways to solve them. As a result of the study, the following criteria for evaluating the expert task were formu-lated: the expert's expert specialty necessary to perform the assigned type of exper-tise; the correspondence of the questions posed to the assigned type of expertise; the need to normalize the wording of the expert task; the need to provide additional materials. The practical significance of the obtained conclusions is that through crit-ical evaluation of the content of the expert task the expert gets the opportunity to timely identify the errors made by the investigator in the formulation of questions, and make the appropriate decision. The article concludes that the assessment of the expert's report according to the criteria identified allows the expert to decide quickly on the possibility of further production of the expert's report or the submission of relevant motions to the body that has appointed the expert, to enable this possibility.
