Abstract (English):
Based on the positions previously expressed in the author's scientific publications on the essence and structure of special knowledge, the article analyzes the conceptual approaches of E.P. Grishina to the basic aspects of the criminal procedure doctrine of special knowledge. The article critically evaluates E.P. Grishina's understanding of the essence of the categories "use" and "application" in the context of special knowledge, which leads to defects in the classifications developed by the author. The author argues for a view on the phenomenon of "diffusion of special knowledge" in modern conditions of the development of the information society, the expansion of the scope of special knowledge and the range of subjects possessing them, which is reflected in the role of legal knowledge in the structure of the phenomenon of "special knowledge". The author of the article provides arguments regarding the meaninglessness of formulating a general definition of "special knowledge" and the introduction of this definition in Article 5 of the Criminal Procedure Code of the Russian Federation, substantiates the advantage of a two-level definition, which ultimately allows to determine the essence of special knowledge used by a forensic expert.
