Abstract:
Based on the positions previously expressed in the author's scientific publications on the legal nature of special knowledge, the specifics of the legal status of persons who possess it, and the forms of application and use of special knowledge, the article analyzes the conceptual approaches to the basic aspects of the criminal procedural doctrine of special knowledge and the proposals formulated on their basis to improve the criminal procedure law. The author examines the presented E. P. Grishina's novels on improving the procedural status of a specialist, fixing certain status norms for a teacher, a knowledgeable witness. The approach used in this case is critically evaluated, based on the identification of such participants in criminal procedural relations as a teacher and a psychologist as independent procedural figures. The author argues that it is erroneous to associate a specialist, as a participant in the criminal process, with an official who conducts preliminary research and studies of objects outside the framework of procedural relations. It proves the inexpediency of granting a specialist in the conduct of a forensic examination the rights characteristic of persons who have their own or represented interests in the case.
