Abstract:
The article analyzes the current state of practice of involving this source of information in evidence in criminal cases on the basis of the author’s positions on the essence of the expert opinion as evidence. A retrospective of the legal positions of the Plenum of the Supreme Court of the Russian Federation and the Constitutional Court of the Russian Federation regarding the legal nature of the expert’s opinion is conducted, it is emphasized in the light of these ideological guidelines that the expert is not entitled to conduct research. The article analyses the corrections made in 2021 by the decision of the Plenum of the Supreme Court of the Russian Federation of December 21, 2010 No. 28, which resulted in a change of opinion of the judicial community on the advisory function of a specialist in evidence in criminal cases. It is substantiated that the new approach of the Plenum of the Supreme Court of the Russian Federation, which excludes the admissibility of an expert opinion assessment by a specialist, limits the cognitive possibilities of the court and other subjects of evidence.
