Abstract:
The article analyzes conceptual approaches of E. P. Grishina to basic aspects of criminal procedure teaching on special knowledge based on the author’s positions previously expressed in scientific publications about the essence and structure of specialized knowledge. Critical assessment of E. P. Grishina's understanding of the essence of "use" and "application" categories in the context of special knowledge, which leads to defects in the classifications developed by her. The view on the phenomenon of "diffusion of special knowledge" in modern conditions of development of information society, expansion of scope of application of special knowledge and circle of subjects possessing them is argued, which reflects also on role of legal knowledge in structure of phenomenon of "special knowledge". Arguments are raised regarding the senselessness of formulating a general definition "special knowledge" and introducing this definition into Article 5 of the Criminal Procedure Code of the Russian Federation, the advantage of two-level definition is justified, to finally determine the nature of special knowledge applied by a forensic expert.
