The article deals with the subjects of enforcement power, and analyses the concept of «judicial» and «judgment» discretion is the definition of enforcement power. The majority of Soviet scientists recognized as an authority not only public authorities but also of other subjects of law. In the modern period entities discretion in enforcement activities, able to act as state and municipal authorities and different legal entities, and in some cases themselves citizens of the Russian Federation. Practice of delegating the discretion of citizens in the law enforcement process is not widely used, because this activity should be present only in the areas of legal regulation, directly affecting the interests of citizens, allowing to consider the will of the participants, and this is very problematic. Enforcement discretion is an activity that is carried out by authorized entities, which include state and municipal authorities, legal persons, and also in cases stipulated by law and the citizens of the Russian Federation.
