APPLICATION OF THE CAUSAL METHOD AND THE METHOD OF HISTORICISM IN THE PRODUCTION OF JUDICIAL RELIGIOUS EXPERTISE

Abstract:
Currently, there is an increase in extremist crimes on religious grounds in the Russian Federation. The investigation of relevant criminal cases has its own specifics and requires the use of all evidentiary tools available to the investigator (inquirer), prosecutor, court. In judicial practice, such a type of evidence as judicial religious studies expertise is increasingly being used, which, due to the lack of state recognition, has a number of problems. One of them is the lack of generally accepted methods that allow experts to competently and efficiently analyze the materials submitted for research during the formation of an expert opinion. The article discusses the prospects for the development of both judicial religious studies expertise and the institute of forensic examination as a whole. On the basis of expert practice, the existing private expert methods used for the production of judicial religious studies expertise are presented. The analysis of common special methods used in the course of forming the conclusion of an expert religious scholar is carried out. The result of the work was the justification of the need to improve the methodological support of judicial religious expertise, as well as the argumentation of the possibility of creating generally accepted methods of conducting such an examination based on the proposed private expert methods. The results of the work can be applied in the formation of the research part of the expert's opinion in the production of judicial religious studies expertise.
